Kelly Rutherford loses custody battle, report says

More than six years later, actress Kelly Rutherford has reportedly lost her legal battle to gain full custody of her two children with her ex-husband, Daniel Giersch.

According to the Daily Mail, a judge in Monaco, where Giersch has lived with the children for the past three years, granted full custody to Giersch, 41.

Rutherford, 47, will only be permitted to "exercise her visiting and accommodation rights exclusively in France and Monaco."

The ex-couple was ordered to split Christmas, spring and summer vacations.

In August, a judge in the United States ordered the 'Gossip Girl' actress to return the children-- both U.S. citizens-- to their father.

"I have no words," Rutherford said at the time exiting the courtroom.

The contentious custody battle began in 2010 when Rutherford and Giersch divorced.

At the time, he told the judge his visa had been revoked.

The judge ruled it would in the best interest of the children to live with their father since their mother had the means to travel abroad.
