Doctor sues patient over bad Yelp review

Michelle Levine went for her annual gynecological exam in 2017. She says the experience freaked her out because the Manhattan doctor never gave her a pelvic exam and then overcharged her.

So she posted a review on Yelp calling the practice a "scam." Levine said she felt she was scammed because she wasn't given a proper exam.

The doctor sued her for defamation. Dr. Joon Song's attorney said, "While everyone is entitled to their opinion, outright lies masquerading as reviews can inflict serious damage to a medical practice or small business."

Yelp chimed in.

"Several states... have enacted strong anti-SLAPP laws that protect consumers from lawsuits intended solely to silence them for honestly speaking out about their experiences," Yelp said in a statement. "Unfortunately, New York residents like Ms. Levine don't currently have the protection of such strong legislation."

Fox 5 spoke to attorney Erin Erhlich about the case.

"Unfortunately, there's really not a whole lot you can do to prevent an unhappy business owner from coming after you if you give them a negative review," Erhlich said. "The most that you can do is tell the truth."

Levine started a GoFundMe page to help with legal fees. She said she is not in it for the money. In fact, 20 percent of her goal will be donated to protecting online free speech and to a women's health advocacy group.
